Expert Witness and Consulting Services

Parker MacIntyre attorneys are available to serve as expert witnesses and consultants in a wide variety of securities law areas. In particular, Daniel MacIntyre regularly consults and testifies in securities arbitrations. He also consults and testifies in court litigation, including cases brought by securities regulatory authorities, such as the U.S. Securities and Exchange Commission and state securities commissioners. Additionally, he assists, and sometimes testifies, in mediations and criminal cases. He has also testified in non-securities cases, such as divorce, trust and estate cases that have a securities component.

Mr. MacIntyre urges those who expect to need expert witness services to contact him as early in the process as is feasible so that he can work with the attorney to shape the case in order to maximize the impact of his testimony on the outcome of the case. He also can help the attorney identify weaknesses in his or her client’s case, and counsel on ways to deal with those.

In addition to his testimonial work, Mr. MacIntyre provides expert consultation in connection with disputes and transactions potentially involving securities law issues. He works with attorneys who have potential securities law issues in transactions, negotiations and disputes to identify those issues before they become critical problems. Often, the question that needs to be answered is whether a transaction implicates the securities laws at all.

Mr. MacIntyre brings to his expert witness qualifications a forty-five year legal career. That career has included representing the Georgia Securities Commissioner as an Assistant Attorney General for the state of Georgia, and representing the Teacher’s Retirement System of Georgia in a $15 million federal securities law case in that same capacity. During his forty-year career in private practice, Mr. MacIntyre has assisted clients in structuring and offering private placements of securities. He has also represented both securities brokers and securities brokers' aggrieved customers in litigation and arbitration. He is particularly proud of a $5,201,550 award that he obtained for his clients against a major national bank and brokerage firm.

Mr. MacIntyre has presented at many continuing legal education seminars. He currently serves as an arbitrator in FINRA arbitrations. He is a member of the Securities Expert Roundtable, the preeminent national association of securities experts. He is the author of an article in the Georgia State Bar Journal about when real estate investments are securities.
